Terms of Service

Last updated: May 24, 2026

These Terms of Service (the “Terms”) form a binding agreement between you and LabTestly (“LabTestly”, “we”, “us”, or “our”) and govern your access to and use of labtestly.com and related services (the “Service”). Please read them carefully.

1. Acceptance of these Terms

By creating an account, uploading a report, or otherwise using the Service, you confirm that you have read these Terms, that you understand them, and that you accept them. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

2. The Service

LabTestly is an informational software tool that uses automated processing, including artificial intelligence, to help you understand laboratory test results in plain English. Features may include parsing uploaded reports, presenting biomarkers with general educational context, generating written summaries, and answering questions through an in-app assistant about reports you have provided. The Service is offered “as is” for general informational purposes only and is not a medical service.

3. Not medical advice

The Service does not provide medical advice, diagnosis, treatment, or prescriptions. It is not a medical device, a clinical decision support system, a doctor, or any other licensed healthcare professional. Always seek the advice of a qualified healthcare professional with any questions you have about a medical condition or about results the Service describes. Use of the Service does not create a doctor-patient, clinician-patient, or other professional healthcare relationship. Please review our Medical Disclaimer for the full statement.

4. Eligibility and accounts

The Service is intended for adults aged eighteen and over, or the age of majority in your jurisdiction, whichever is higher. To use most features you must create an account. You agree to provide accurate information, to keep that information current, and to keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorised use. We may suspend or close accounts that appear inactive, fraudulent, or in breach of these Terms.

5. Uploaded reports and health data

You may upload laboratory reports only if (a) they relate to you, or (b) you have the informed consent of the person they relate to, or you are otherwise legally permitted to share that information with us for the purposes of the Service. You confirm that you have the authority to provide the content you upload and that doing so will not violate any third-party right or applicable law. You are responsible for the accuracy of what you upload.

6. Subscriptions, billing, and cancellation

Some features of the Service are offered on a paid basis. Subscriptions and one-off purchases are processed by our payments processor, which acts as merchant of record. By starting a paid plan you authorise recurring charges in accordance with the plan you select, until you cancel. Cancellations take effect at the end of the then-current billing period; paid features remain available until that date. We may change plan features and prices on reasonable notice; changes apply to billing periods that begin after the change. Except where required by law, fees already paid are non-refundable. If you believe you have been incorrectly charged, contact [email protected] within thirty days of the charge so we can investigate. Payments, taxes, invoices, chargebacks, and refunds may also be subject to the terms and policies of our payments processor or merchant of record.

7. Acceptable use

You agree to use the Service only for its intended educational purpose and to comply with all applicable laws when you do. You will not interfere with the operation of the Service, attempt to access accounts or data that are not yours, or disrupt other users’ experience.

8. Prohibited use

You may not:

  • use the Service for emergency medical situations or any clinical decision-making;
  • upload another person’s health information without their informed consent or other lawful basis;
  • scrape, harvest, or systematically extract content or data from the Service;
  • reverse engineer, decompile, or attempt to derive the source code, models, or training data of the Service;
  • introduce malware, attempt to bypass access or rate-limit controls, or otherwise compromise the integrity of the Service;
  • resell, sublicense, or commercially redistribute the Service or its output, except as we expressly permit;
  • use the Service to defame, harass, defraud, or impersonate any person, or to violate any law or third-party right.

9. AI output and limitations

The Service generates explanations and answers using artificial intelligence. AI output may be inaccurate, incomplete, outdated, or misleading; it may misread numbers, units, reference ranges, or clinical context. We take reasonable steps to keep the Service grounded in your report and presented calmly, but we do not warrant the correctness of any AI output. Treat every explanation as a starting point for a conversation with your healthcare provider, not as a conclusion.

10. Your content and licence to us

You retain ownership of the reports, messages, and other content you submit to the Service (“Your Content”). To provide the Service to you, you grant LabTestly a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, process, display, and create derived representations of Your Content, solely as needed to deliver and maintain the Service. This licence is limited to operating, securing, maintaining, troubleshooting, and providing the Service to you. It does not allow us to sell your lab report content. We do not use your lab report content or assistant conversations to train general-purpose AI models. This licence ends when Your Content is deleted from our systems, subject to limited retention required for legal, tax, or backup purposes.

11. Third-party services

The Service relies on third-party providers acting as our processors, referenced by category: a cloud platform provider for authentication, database, and file storage; one or more artificial-intelligence providers for generating explanations and assistant responses; a payments processor for checkout and subscription billing; a transactional email provider; a hosting and edge infrastructure provider; and a rate-limiting and abuse-prevention provider. We may change providers from time to time without amending these Terms. We take reasonable steps to select providers that support appropriate confidentiality, security, and reliability.

12. Intellectual property

The Service, including the LabTestly name and logo, the software, the user interface, the prompts, the underlying knowledge base, and all related materials, is owned by LabTestly or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-sublicensable licence to use the Service for its intended educational purpose. All rights not expressly granted are reserved.

13. Privacy

Our processing of personal information is described in our Privacy Policy, which forms part of these Terms.

14. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, LabTestly disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of AI output, availability, freedom from interruption or error, and any warranty that the Service will meet your requirements. We do not warrant that the Service is suitable for any clinical, diagnostic, regulatory, or treatment purpose.

15. Limitation of liability

To the maximum extent permitted by law, LabTestly and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Service. Our total aggregate liability for direct damages arising out of or related to these Terms is limited to the greater of (a) the fees you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) one hundred United States dollars. You acknowledge that the Service is not a substitute for professional medical advice and that any health decision you make in reliance on the Service is at your sole risk. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the smallest extent permitted by law.

16. Termination

You may stop using the Service at any time and may close your account by contacting [email protected]. We may suspend or terminate your access, with or without notice, if you breach these Terms, if your use poses a risk to the Service or to other users, or if we are required to do so by law. On termination, your right to use the Service ends; clauses that by their nature should survive termination — including the sections on prohibited use, intellectual property, disclaimers, limitation of liability, and governing law — will survive.

17. Changes to the Service and these Terms

We may modify or discontinue features of the Service at any time. We may also update these Terms from time to time. When we make material changes we will notify you in the Service or by email, and we will update the “Last updated” date at the top of this page. Continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, stop using the Service.

18. Governing law

These Terms are governed by the laws applicable to the entity operating LabTestly, unless mandatory consumer-protection law provides otherwise. Disputes arising out of or related to these Terms will be brought in the courts of that jurisdiction, except where mandatory local consumer-protection law gives you the right to bring proceedings in your country of residence. Mandatory local consumer-protection rights may still apply.

19. Contact

Questions about these Terms can be sent to [email protected].
